The Failure of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the announcement of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been contained. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its response: another massive barrage of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are waged: positive announcements are released from various governments. Significant resources is allocated on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track projectile deployments from Russian territory, a capacity provided through up-to-date information. From vantage locations, military aircraft that had been deployed to engage hostile aerial threats roared overhead – modern combat jets supplied to Ukraine by NATO members.

Moments later, Kyiv's missile defense thundered: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by allied countries. Every firing jolts you unexpectedly, causing tremors. The brief panic quickly transforms into grim resignation: maybe the incoming missile won't cause damage this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Following this, a heavy machine gun fired at a drone close by, part of a mobile-fire group – almost certainly imported technology. Regrettably, the shots failed to hit the opposing UAV – it maintained course toward its target.

With pauses, this continued until dawn. Kyiv faced the morning news: multiple fatalities, destruction and heating outages in numerous residences as a result of the nocturnal offensive. As customarily, everyone still continued their routines – living the war. But those full day demonstrated Ukraine's essential dependence on external assistance – a need that neighboring countries are demonstrably unable to substitute in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from US administration provoked deep reactions, controversy and serious worry – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and multilateral gatherings.

Every new approach from Washington unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually win the battle. This trend will, undoubtedly, persist.

Political Considerations

It is easy to blame particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. American leadership works based on a principle well known to experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The US administration assumes that it is impossible to pressure the Kremlin to abandon the land that it presently holds in Ukraine's occupied territories.

The issue is that while accepting these circumstances, Washington does minimal to discourage Russia, through statements or actions, from assuming that the situation will not shift further in its favour in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that time is on his side – that Ukraine and its supporters are nearing depletion. Their reason to agree to terms that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still hold out, progressively conceding people and territory but preventing a total frontline collapse until circumstances change in its favour.

Current Realities

Realistically, there are no actual prerequisites for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to mediate resolution and achieve global acclaim, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any initiative Kyiv finds unsuitable, so that their focus does not shift toward domestic problems. And although their mission will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are influencing discussions.

Conclusion and Outlook

It took a mere seven days to terminate the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, pushback by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, recent disclosures, all did their job.

While new plans based on established approaches are forthcoming, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and show specific hesitation to change the course of events, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, primarily depend on continued Western support.
